How adoption works in Quebec
In Quebec, an adoption is never just a private agreement: it must be granted by a judge of the Court of Québec, Youth Division. In broad terms, most adoptions follow the same path:
- Consent: the child's parents, or a tutor in some cases, usually consent to the adoption. Older children must also be asked, and their refusal can stop the adoption. Without consent, the court may in some situations declare the child eligible for adoption, for example after abandonment.
- Placement order: the court confirms that the conditions are met and places the child with the adoptive parent. This step is required even when you adopt your spouse's child.
- Adoption judgment: after the child has lived with you for a period, the court grants the adoption if it is in the child's interest. You then become the child's legal parent, with the same rights and duties as any parent.

Common types of adoption
Adopting your spouse's child
Intrafamily adoption, such as adopting your spouse's or partner's child, is one of the most common situations. The government is usually not involved in the same way, but the court process still applies, and the consent of the child's other parent is a central question. Your spouse keeps all their rights as a parent.
Adoption through youth protection (Banque mixte)
Some children cannot stay with their birth family and are followed by the Director of Youth Protection (DPJ). Through the Banque mixte program, approved families first foster a child with the possibility of adopting later.
